It's not just a question of the battery moving, what about when your disconnecting/connecting the leads or removing the clamp?? very easy to short out the battery.

No point in taking a chance when you don't have to, IMHO
It could have been positioned an inch further forward away from the terminalsand insulated along its length, I certainly would have and would recommend that anyone fitting a similar type clamp does the same.
